FIREARM-RELATED PRODUCT ACKNOWLEDGMENT
This product is a firearm-related accessory or component and must be treated accordingly. Firearms and firearm accessory laws are complex, jurisdiction-specific, and subject to frequent change through legislation, regulation, administrative interpretation, or court ruling. Magco Arms does not provide legal advice. The purchaser and user accept sole responsibility for researching, understanding, and complying with all applicable laws and regulations concerning this product, including but not limited to those governing:
• Purchase and acquisition
• Possession and ownership
• Installation and configuration
• Use, storage, and transport
• Modification or combination with other products
• Transfer, resale, inheritance, or disposal No statement, advertisement, or omission by Magco Arms shall be construed as a representation of legality in any jurisdiction.
USER COMPETENCY & SAFE HANDLING RESPONSIBILITY
This product is intended for use only by individuals with sufficient knowledge, training, and experience to safely handle firearm-related equipment. The purchaser and user acknowledge that improper handling, careless use, lack of inspection, or failure to recognize unsafe conditions may result in serious injury, death, or property damage. All risks associated with user error or lack of experience are expressly assumed by the user.
CRITICAL INSTALLATION, ASSEMBLY & INSPECTION WARNING FAILURE TO CORRECTLY INSTALL, SECURE, AND MAINTAIN THIS PRODUCT MAY RESULT IN CATASTROPHIC FAILURE.
Improper assembly, insufficient securing of components, loosening during use, failure to perform routine inspection, continued use after damage is detected, misuse, abuse, or neglect may cause severe equipment damage, personal injury, or death. The user is solely responsible for:
• Inspecting the product before and during its service life
• Confirming all components remain properly seated and secured
• Monitoring for wear, loosening, deformation, or abnormal function
• Immediately discontinuing use upon detection of any unsafe condition Magco Arms assumes no responsibility for failures resulting from improper installation, inspection, or maintenance.
ASSUMPTION OF RISK
The purchaser and user knowingly, voluntarily, and expressly assume all risks, whether known or unknown, foreseeable or unforeseeable, arising from or related to:
• Possession or handling of the product
• Installation, assembly, or configuration
• Intended or unintended use
• Misuse, abuse, or negligence
• Modification or alteration
• Interaction with other equipment or components
• Inability or failure to use the product This assumption of risk applies regardless of warnings provided or not provided.
RELEASE, DEFENSE, INDEMNIFICATION & HOLD HARMLESS
To the maximum extent permitted by law, the purchaser and user agree to fully release, defend, indemnify, and hold harmless Magco Arms and its owners, officers, members, managers, employees, contractors, agents, affiliates, distributors, dealers, insurers, and successors from any and all claims, demands, causes of action, damages, losses, liabilities, penalties, costs, or expenses (including attorneys’ fees) arising from or related to:
• Personal injury, bodily harm, or death
• Damage to firearms, accessories, or other property
• Product malfunction, wear, or failure
• Improper installation, inspection, or maintenance • Negligent, reckless, unlawful, or unintended use
• Unauthorized modification or combination with other products
• Violation of any law, regulation, or ordinance
• Claims asserted by third parties
• Civil, administrative, or criminal proceedings This obligation applies regardless of legal theory, including negligence, strict liability, or alleged defect, and survives purchase, resale, transfer, or discontinuation of use.
LIMITATION OF LIABILITY
In no event shall Magco Arms be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:
• Loss of use
• Loss of income or profits
• Business interruption
• Legal or regulatory consequences This limitation applies even if Magco Arms has been advised of the possibility of such damages.
MODIFICATIONS, ALTERATIONS & NON-STANDARD USE
Any alteration, customization, or use outside of intended or standard parameters immediately voids any responsibility or liability on the part of Magco Arms. All modifications are performed entirely at the user’s own risk.
EXPORT & REGULATORY COMPLIANCE
The purchaser and user are responsible for compliance with all applicable export, import, and international regulations. Unauthorized export or transfer may violate domestic or international law and is strictly prohibited.
SEVERABILITY
If any provision of this agreement is held unenforceable or invalid, such determination shall not affect the remaining provisions, which shall remain in full force and effect.
GOVERNING LAW & VENUE
This agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Magco Arms is organized, without regard to conflict-of-law principles. Venue for any dispute shall lie exclusively within that jurisdiction, to the extent permitted by law.
ENTIRE AGREEMENT & ACCEPTANCE
This document constitutes the entire agreement between the parties regarding this product and supersedes all prior communications or understandings. By purchasing, opening, possessing, assembling, or using this product, the purchaser and user acknowledge that they have read this agreement in its entirety, understand its contents, and agree to be legally bound by its terms.
